Terms & Conditions

In these terms and conditions:
'He' means the person making the booking and signing the booking form.
'You', 'the tenant', 'the tenants party', 'the tenants visitors' and 'your' means all persons named on the booking form (including anyone who is added or substituted at a later date).
'We', 'us' and 'our' means SARL Marcassin

1. Booking Contact us before making a booking to confirm availability. If available a provisional reservation will then be made. The following must then be sent to us:

  1. The completed and signed booking form. The person who signs this form certifies that he is authorised to agree the Booking Terms and Conditions on behalf of everyone included on the Booking Form, as well as anyone added at a later date. The signatory must be a member of the party occupying the property and must be 18 years or over.
  2. A non-refundable payment of 25% of the rental cost.

2. Payment The rental balance (75%) and damage deposit must be paid 8 weeks before your arrival at the Château. If you do not pay on time we will consider the booking cancelled and you will forfeit your deposit. Bookings made within 8 weeks of your arrival must be paid in full including the damage deposit.

3. Damage deposit A damage deposit of 1,500€uros is required to cover the cost of any damages or breakages at the Château, any additional cleaning and the cost of telephone calls. This amount will be cashed 8 weeks prior to your arrival at the Château. This damage deposit, which does not limit the tenant's liability for damage, will be returned to the tenant within 2 weeks of the end of the rental period less an amount for damage, extra cleaning and tidying (over and above the hours normally taken cleaning) and additional services. If the damage deposit paid by you is not sufficient to cover the cost of any services or damage SARL Marcassin is entitled to recover any additional costs from you. Some damages may not be immediately obvious on your departure. We reserve the right to charge you for any damage noted in the property after your departure. We also reserve the right to hold the security deposit for longer than 4 weeks if there is a dispute over damage or we are awaiting bills for repair.

4. Contract Once we have received your booking form and all appropriate payments, we shall confirm your booking by issuing a confirmation invoice. A legally binding contract between you and SARL Marcassin will come into existence on receipt of your cheque or credit card payment.

5. Cancellation Any cancellation by you, the tenant (for whatever reason) must be in writing (including email or fax). The effective date of cancellation is the date we receive written notification. Cancellation charges will be applied as follows:

If we find a replacement client we shall refund all payments to you less any difference between the price you paid and that paid by the replacement client.

6. Your responsibilities You must keep the property and all furniture, fittings, equipment and grounds in the same state of repair and condition as at the commencement of the holiday and in the same state of cleanliness and general order in which it was found. You will be responsible for the payment for any breakages, loss or damage to the property caused by you. (We recommend that you take out adequate insurance cover to cover this). SARL Marcassin reserves the right to make deductions from the damage deposit for any extra cleaning, over the number of hours committed to departure cleaning, and to claim against you for any damage or loss, the cost of which exceeds the security deposit.

7. Number of people staying at the Château A maximum of 12 people plus one infant may stay at the Château. SARL Marcassin has the right to terminate rental without prior notice and without refund or compensation if the numbers are exceeded.

8. Camping No caravans or motorhomes may be parked at the Château or tents pitched at the property.

9. Owners access SARL Marcassin staff shall be allowed access to inspect the property prior to your departure. They also have a right to access the property during your stay to carry out urgent maintenance. Gardeners and pool maintenance staff enter the grounds during your stay.

10. Behaviour The person signing the contract is responsible for the correct and decent behaviour of the party. Should you or a member of the party not behave in such a manner, SARL Marcassin may use their absolute discretion to terminate the holiday of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation. SARL Marcassin will have no further responsibility toward such person(s) including any return travel arrangements. No refunds will be made and we shall not pay any expenses or costs incurred as a result of the termination.

11. Additional services It is possible to book the services of a chef, baby sitter or complimentary therapist for some of your stay. If you would like any of these services please advise us at time of booking and we shall put you in touch with them to enable you to make your own arrangements. Any contract you enter into for these services is with the supplier concerned.

12. Linen Linen is included, as are 2 towels per person plus a pool towel. Linen is changed once a week. If you require more frequent changes you should request this at the time of booking. (There will be an additional cost).

13. Swimming pool The swimming pool will be attended to regularly. Tenants must not interfere with the pool cleaning robot. The pool liner and poolside equipment must be treated with care. Plastic beakers are be used in the pool area, to avoid broken glass in the pool. The swimming pool is not open all year round. If your rental period is outside July & August, please check with us that the pool is open. Please note that swimming pools carry their own inherent risks. Upon arrival at the property you and all members of your party must take time to familiarise yourselves with the pool. There is a security fence constructed according to French regulations, and on no account may the gates be propped open. Young children must not be allowed to wander unaccompanied in the park.

14. Snooker table No children under the age of 14 may use the snooker table.

15. Social events and other functions If you intend to organise a function (e.g. party, wedding, cocktail party) at the property, you must seek prior permission from us. Additional charges and/or damage deposit may be payable

16. Security and valuables Any valuables left at the property are left at your own risk. We are not responsible for any loss. Proper care be must be taken against theft and burglary. It is essential and your responsibility to ensure all doors, shutters, windows are closed and locked when leaving the property. No refund can be given should you decide to vacate the property as a consequence of a burglary.

17. Arrival and departure times Arrival is between 5pm and 7pm local French time. If your arrival is delayed you must inform us. If you arrive after 7pm (without making arrangements to arrive late) you may not be able to gain access to the property until the following day. You must vacate the property by 10am on the day of departure in order to allow the Château to be prepared between lettings. If these times cause you difficulty, please advise us at the time of booking. We will not be able to guarantee any changes can be made after the booking.

18. Pets No dogs or other pets are allowed on the property.

19. Stilettos No stilettos to be worn upstairs as both the floor on the upstairs landing (palier) and bedroom 5 are new.

20. Vineyard This is a working vineyard and winery. There may be the occasional noise from tractor or lorry movements, but the Château and its park are completely separate from the vineyard. For your own safety you (but no unaccompanied children) may enter the yard by prior arrangement only, for the purposes of wine-tasting or purchasing wine. All children must stay in the park.

21. Accidents Although every effort has been made to ensure your comfort and safety, Château de Fayolle is an ancient and historic house in an equally ancient setting - tenants, and especially those with children must be aware of this, particularly keeping the upstairs windows closed, and assessing other dangers. SARL Marcassin accepts no responsibility for accidents suffered by the tenant or the tenant's party or their visitors.

22. Complaints If you have any problems or complaints please contact us immediately. Complaints received at the end of the holiday will not be accepted. If the problem was not resolved to your reasonable satisfaction during your holiday, you should put your comments in writing within 7 days of your return.

23. Insurance All tenants must have appropriate travel insurance.

24. Low slung cars People arriving in low/sports cars are advised that the drive is not tarmac and that SARL Marcassin accepts no responsibility for any damage caused to a vehicle by gravel from the drive. All cars and their contents are parked at the owners risk.
